UpFlux, with the scope of committing to USERS to ensure the security and privacy of information transmitted and received through its website and applications, publishes its “PRIVACY NOTICE”, based on the principles of its commitment to transparency and respect for USERS. The term USER means any individual or legal entity that interacts, visits or uses any content published under the domain UpFlux.net. And other services offered by Smart Process electronically.

Who we are?

UpFlux is a technology startup that helps companies increase their operational efficiency through Artificial Intelligence and Process Mining techniques. Its purpose is to provide transparency and agility for the understanding and improvement of workflows.

What we collect about you?

Personal information means information that can be used to identify you. We collect personal information when you become our customer, employee, partner, or supplier; create a user account; subscribe to our newsletter; fill out our forms; request technical support; or talk to us through our service channels and instant messaging applications.

Your information may also be collected when you comment on our blog, interact on one of our social networks, or when someone who knows you has indicated your contact.

We may have information in our database that has been collected by our clients and partners. In this case, we have no decision-making power over the data, we only act as an operator and process it as requested by our client or partner, who in this case, assumes the role of controller.

Finally, when you access our website, system, or application, we may also collect information such as: the type of your browser, the IP address of the USER’s computer, date, and time of access. This information may be aggregated to measure the number of visits, average time spent, page views, and other statistics, as well as identifying access for registration purposes for security of application servers and traceability of user actions and mainly downloading of files from the operator to which the user is linked.

Personal data is treated as confidential and is used to provide our services. UpFlux anonymizes consolidated data reported by USERS to generate statistical and performance reports. These data do not identify USERS or any other individuals.

All data obtained through UpFlux channels are confidential and can only be used by the USER and their authorized representatives to comply with the agreement between the parties. UpFlux commits to comply with all applicable regulations regarding personal data treatment used or obtained within its activities, concerning privacy, confidentiality, security, and personal data protection. Furthermore, UpFlux must maintain security tools according to the best available technology to prevent the loss or any unauthorized access to this data.

The information available on our websites, systems, and applications contains a security structure with technology that protects digital information and limits the use of confidential information, subjecting it to certain rules of use established by UpFlux and its representatives.

UpFlux is committed not to sell, rent, or disclose USER information, except in cases of an official request by any public authority and in cases provided for in the “PRIVACY NOTICE” or contracts agreed with the USER.

The USER is solely responsible for maintaining access password to our systems. They should promptly notify UpFlux regarding any unauthorized use of their account or any unauthorized access by third parties. Security breaches of UpFlux websites, systems, or applications may result in civil and/or criminal liability.

Your Rights as a Data Subject

By law, you can ask us what information we have about you, for what purposes we have it, and also update and correct inaccurate data. If we request your consent to process your personal data, you can withdraw that consent at any time.

Who we share your data with

We may share some of your data with our partners and service providers related to the operation of UpFlux. These shares are necessary for us to provide services that meet your needs. Some of these providers are: accounting and financial services, health and benefits plan operators, internet service provider, cloud storage service.

We use Google and WhatsApp tools for communication, analytics, forms, and marketing strategies. Therefore, some data such as phone number and/or cellphone, provider IP, geolocation, date and time of access, data entered in our forms, as well as interactions on our social media are shared with Google, WhatsApp, and Builderall.

We use vendors who are committed to privacy and information security. If you want to know which companies we use to process some of your personal data, please contact us.

How long we keep your data

We retain your personal data for as long as necessary to fulfill the purpose for which it was provided or collected, including compliance with any legal requirements. We may also retain personal data to fulfill our legitimate interests, maintain security, prevent fraud and abuse, resolve legal disputes, enforce our Terms of Use, or any other agreement with you.

UpFlux reserves the right to update, review, supplement or otherwise modify this “PRIVACY NOTICE” at any time and periodically and impose new or additional rules, policies, terms, or conditions on the use of the services offered through the channels mentioned above or interactions with its system, hereinafter referred to as UpFlux.

Therefore, we recommend that the USER periodically access the UpFlux website to be informed about these changes.
